Asylum Seeker Criminal Cases At Risk

“Institutional recklessness” of Federal Police may give rise to appeals.

It was recently revealed that a systemic failure by the Australian Federal Police could result in multiple appeals, after it came to light that officers failed to properly comply with the Commonwealth Crimes Act.

The Court heard that it was standard practice to ignore the requirement for an identification parade were the accused was a detainee. Instead of an identification parade, investigative officer showed a witness a series of photographs.
